Erosion Control

The City of Rocky Mount administers an Erosion Control program within the city limits. This program operates under the Land Quality Section of the North Carolina Department of Environmental and Natural Resources (NCDENR). The City of Rocky Mount has local jurisdiction in administering the Sedimentation Pollution Control Act of 1973, and does so by way of the Soil Erosion and Sedimentation Control Ordinance (Land Development Code Section 801).

In accordance with the Act and LDC Section 801, an Erosion and Sediment Control Plan, designed in accordance with the NCDENR Erosion & Sediment Control Planning and Design Manual, must be filed with and approved by the City of Rocky Mount prior to disturbing an area of greater than one acre. For disturbances less than one acre, no plan must be filed; however, all requirements limiting erosion remain in effect. The Engineering Department has three inspectors who ensure compliance with the Act. Prior to large scale grading of sites larger than an acre, the assigned inspector must first approve the installation of the required erosion control measures.

In the event of non-compliant land disturbing activities, a Notice of Violation is issued directing the financially responsible party to bring the site into compliance. If the site is not brought into compliance, the financially responsible party would be subject to a civil penalty of up to $5,000 per day per violation and may be charged with a class two misdemeanor.
